INTRODUCTION FOR FSSAI REGISTRATION


FSSAI License is issued by the Food Safety and Standards Authority of India (FSSAI), Ministry of Family Health & Welfare, Government of India. FSSAI License is a license or registration required to be obtained by all food manufacturing, processing, distributing or packaging entity.

This License is governed by The Food Safety & Standards Act, 2006. This Act focuses on improving the hygiene and quality of food available in the market for sale. As per the Act, no person shall commence or carry on any food business except under a FSSAI license or FSSAI registration. Application to commence a food business must be made to the FSSAI in the prescribed format. Based on the application and supporting documents, FSSAI will accord approval to applying entity.

Key Points of FSSAI Registration


License Type

FSSAI Licenses are of two main types, State License and Central License. Food manufacturers which are medium sized including Hotels and restaurants are required to obtain State Level License while the Large sized manufacturers are required to obtain Central License.

Multiple Licenses

FSSAI License are required to be for each place where food is handled. Therefore, if an entity has multiple locations of food handling, then he is required to obtain separate license for each place.

Exemption

Few industries like hawker, itinerant vendor or a temporary stallholder or small scale or cottage or such other industries relating to food business or tiny food business operator are exempt from obtaining FSSAI Registration or License.

Validity

Once a FSSAI License is issued, it is valid for one or two years. Before end of its validity, the license can be renewed for a further term.

Documents Requried for State FSSAI Registration


  • Form B duly completed and signed by Proprietor/ Partner
  • Blueprint/ Layout of the processing Unit showing the dimension in meters/ square meters and
  • Operation wise area allocated (mandatory for manufacturing or processing units)
  • List of Directors/ Partners/ Proprietors with full address and contact details (mandatory for companies only)
  • Photo ID and address proof issued by Government authority of Authorized Signatory.

Documents Requried for Central Manufactring FSSAI Registration


  • Form B duly completed and signed by Proprietor/ Partner
  • Blueprint/ Layout of the processing Unit showing the dimension in meters/ square meters and operation wise area allocated (mandatory for manufacturing or processing units)
  • List of Directors/ Partners/ Proprietors with full address and contact details (mandatory for companies only)
  • Name and List of Equipments and Machinery along with the number, installed capacity and horsepower used (mandatory for manufacturing or processing units)
  • Photo ID and address proof issued by Government authority of Authorized Signatory.
  • List of Food category desired to be manufactured. (In case of manufacturers)
  • Authority Letter with name and address of responsible person nominated by the manufacturer along with alternative responsible person indicating the power vested with them viz assisting the officers in inspection, collection of samples, packing & dispatch (mandatory for manufacturing or processing units)
  • Analysis Report (Chemical & Bacteriological) of water to be used as ingredient in food from recognized / public health laboratory to confirm the portability(mandatory for manufacturing or processing units)
  • Proof of possession of premises (Sale deed/ Rent Agreement/ Electricity Bill)
  • Partnership Deed/ Self Declaration for Proprietorship/ MoA and AoA towards constitution of firm. For MoA- Three pages- Certificate of Incorporation, Authorization of Food business Activity and List of directors with address.
  • Copy of Certificate obtained under Coop Act, 1861(optional)
  • NOC & Copy of License from manufacturer(for relabeled and replacers only)
  • Food Safety Management System Plan or Certificate
  • Source of Milk and Procurement Plan for milk including location of milk collection centers etc (wherever applicable)
  • Source of raw material for meat and meat processing plants (wherever applicable)
  • Pesticide residue report of water in case of units manufacturing packaged drinking water, packaged mineral water from a recognized/ public health laboratory.
  • Recall Plan on whom the product is distributed. (wherever applicable)
  • NOCs from Municipality (wherever applicable)
  • Ministry of Commerce certificate for 100% EOU
  • Supporting Documentary evidence of Turnover
  • NOC/ PA documents issued by FSSAI
  • IE Code Document issued by DGFT
  • Form IX: Nominations of persons by a company along with the Board Resolution
  • Certificate provided by Ministry of Tourism.
  • For transporters-Supporting documentary proof for Turnover or self declaration of number of vehicles

However, in case there is fruit & vegetable processing & godown / store along with it, since these are connected activities, one license is applicable.

    • 6. What is the Difference between License and Registration?
      The petty food business operators who have their annual turnover of upto Rs. 12 lacs require registration certificate. The Food Business Operators who have their turnover of more than Rs. 12 lacs have to obtain a license.
