    When the examiner presents some objections about the registrability of your trademark it is said to be objected to. To overcome the objections, a written response requires to be filed with the Trade Mark Registry. If the Examiner is not persuaded by the written reply, a hearing is scheduled for letting arguments be put forth in person.

    When the Examination report is given by objecting to the registration, a written reply requires to be submitted that provides adequate justification and clarifications about a trademark’s distinctiveness and registrability. If the filed response satisfies the examiner, the mark would be printed in the journal.

    The status of the Trademark Application is needed to be tracked from time to time by the applicant in order to remain updated. When the examination report is given, the status of the application is modified to “Objected” with the alert “Awaiting Reply to Examination Report”.

    No, the applicant of the trademark does not require to stop using the ™ sign. By way of publishing the Examination Report, the Registry does not make to stop the applicant from employing the ™ sign beside the Brand Name or Logo.

    The response to the examination report published by the Trademark Registry is needed to be filed within 1 month from the date of dispatch.     The application, when it is received by the Registry, is published in a journal for a period of 4 months and is open for opposition by the Third Party. After fulfillment of 4 months, where no opposition by the third party is acquired, the Registration Certificate of the trademark is published by the Registry.
