    About Trademark Objection Reply

A trademark application goes through several stages, where Examination by Registry is a crucial one. Trade Marks Act and its Rules would be examined by an officer to check for any errors or correctness of the application.

An examination report is issued with the examiner’s comments following review. When an applicant does not reply to the Registry’s examination report, the application may be abandoned, which compels the applicant to file a reply.

    Advantages of Trademark Objection Reply

    To Prevent Abandonment

For The Registration Process To Proceed, A Reply To The Examination Report Must Be Filed. TM Applications Will Be Abandoned If The Reply To The Trademark Objection Report Is Not Filed Within A Month Of Being Dispatched.

    Establish your Mark's Distinctiveness

Trademark Objection Reply Letters Provide The Applicant With The Opportunity To Explain Why Their Mark Should Be Registered. In A Written Reply To The Report, You Can Demonstrate How The Objections Do Not Apply To Your TM Application And Show The Distinctive Features Of Your Mark.

    Similar Trademark Exists

If Already Registered Trademarks Are Similar To The Applied Trademark Then There Is A High Probability That The Current Trademark Owner May Encounter Objection. The Trademark Application Cannot Be Registered Since There Are Already Registered Trademarks For Comparable Or Identical Goods Or Services As Per The Trade Marks Act Of 1999.

When the examiner presents some objections about the registrability of your trademark it is said to be objected to. To overcome the objections, a written response requires to be filed with the Trade Mark Registry. If the Examiner is not persuaded by the written reply, a hearing is scheduled for letting arguments be put forth in person.

When the Examination report is given by objecting to the registration, a written reply requires to be submitted that provides adequate justification and clarifications about a trademark’s distinctiveness and registrability. If the filed response satisfies the examiner, the mark would be printed in the journal.

The status of the Trademark Application is needed to be tracked from time to time by the applicant in order to remain updated. When the examination report is given, the status of the application is modified to “Objected” with the alert “Awaiting Reply to Examination Report”.

No, the applicant of the trademark does not require to stop using the ™ sign. By way of publishing the Examination Report, the Registry does not make to stop the applicant from employing the ™ sign beside the Brand Name or Logo.

The response to the examination report published by the Trademark Registry is needed to be filed within 1 month from the date of dispatch. However, the Registry gets the response even after the stated period is expired. One may submit the reply till the status of the application displays the alert of “Awaiting Reply to Examination Report” and not “abandoned”.

Once the Trademark objection reply is duly filed by the registered attorney, the reply will also be shown on tracking the application status. Also, the alert “Pending for Reply” or “Awaiting Reply to Examination Report” will be removed from the application status on the TM website. The status would still be “objected” as the processing from the Registry would be pending.

The Trademark Registry usually takes 6 to 8 months to process, confirm and review the reply filed with the registrar.

The show-cause notice for hearing is published in very extraordinary cases, where the trademark applied is very comparable to any other applicant or the examiner who is not happy with the reply filed along with the supporting grounds.

The application, when it is received by the Registry, is published in a journal for a period of 4 months and is open for opposition by the Third Party. After fulfillment of 4 months, where no opposition by the third party is acquired, the Registration Certificate of the trademark is published by the Registry.
